This agreement is between us, ChillDayz Campers, and you, the person/persons signing this agreement as a hirer of one of our vehicles.
Throughout the terms and conditions except where otherwise stated the following words have the following meanings:
- The van/campervan/camper – The Camper Van hired to you under this agreement, including any replacement vehicle.
- We/Us/Our – ChillDayz Campers
- Hirer/You/Your – The person or persons booking the van and signing this agreement
By signing these Terms and Conditions you agree that you have read, understood and accept them and that you will comply with them. We permit you to use the campervan on these Terms and Conditions and of the accompanying Rental Agreement only. ChillDayz Campers hires the campervan (including any replacement vehicle) to you subject to the Rental Agreement which incorporates these Terms and Conditions and the hire information provided below. In entering into this Rental Agreement, you accept these Terms and Conditions and confirm that you will strictly comply with them. The rights and obligations contained in these Terms and Conditions govern your use of our campervan and are not transferable by you. You acknowledge that the campervan is owned by us and that any attempted transfer or sub-letting of the van by anyone other than us is prohibited and a criminal offence. Please read this agreement carefully and if you are unsure or do not understand something then please let us know and we will further explain any aspect of it.
Bookings are secured through any of our managed third-party sites or directly with us through our own website – www.chilldayz.co.uk. The booking is only secured on payment of the hire in full, less deposit.
Hire includes fully comprehensive vehicle insurance provided by Markerstudy Insurance Services Ltd and brokered by Alan Boswell Insurance Brokers with a standard excess of £1,000, depending on your driving history. A copy of the insurance cover particulars can be provided on request. The cost of hire includes insurance for the person making the booking and payment.
Up to two additional drivers can be added to the insurance at a cost of £25 per additional driver. Under no circumstances must the campervan be driven by any persons not covered by this insurance. All named drivers must be present at collection with their drivers licence and proof of address available. All named drivers must sign the Hire Agreement and be bound by these Terms and Conditions.
Please note that hirers from outside of the European Union will be subject to an insurance excess of £1,750 or above.
The conditions of insurance are on the basis that the driver(s) satisfy the minimum standard for insurance cover:
- Aged between 23 and 79 years;
- Hold a clean, unendorsed driver licence or agreed endorsements with us prior to booking;
- Has held a full UK or EU driver licence for at least two years.
Not satisfying any of these conditions may attract an additional rate, which we may pass on to you at our discretion.
Security and Insurance Validation Deposit
In order to validate the insurance cover for the hire our insurance company requires a clear payment between the hirer and the hire company through electronic means. The total security and insurance validation deposit is £500.00, refundable on safe return of the campervan, in the condition in which it left our care (with the interior clean, including all cooking utensils and appliances) subject to an inspection satisfactory to us. This deposit is to cover the possibility of damage (whether negligent, wilful, accidental or otherwise) or loss to the van or the fixtures and fittings therein or the living equipment and windows, wheels, tyres etc included with the van as well as to validate the insurance. The van and all its equipment must be returned in good condition, with no damage to it, its contents or any third-party property.
www.chilldayz.co.uk – £500 is paid on checkout directly to ChillDayz Campers and is fully refundable on safe return of the campervan.
This transaction must have cleared our account before the hire commences. The deposit will normally be refunded within 3 days of the end of the rental period (as long as terms and conditions are met) allowing for speeding tickets, parking fines, congestion charges and any other costs to reach ChillDayz Campers. You will be responsible for any costs of parking fines or other penalties incurred whilst you rent the vehicle. We reserve the right to make reasonable charges for our time incurred and the administration costs involved in processing any fines and/or penalties. At present our administration charge for processing any fines and/or penalties is £50. We also reserve the right to alert police forces of your name and address should we receive an offence notice from your hire period.
Should there be any damage or requirement for any repair, replacement or special cleaning, the costs will be deducted from the security deposit before the balance is returned to you. You irrevocably authorise us to deduct from the Security Deposit any amounts due to us arising out of the Hire Agreement. You agree irrevocably to pay all charges upon request. In the event that there is an insurance claim we reserve the right to retain the security deposit for such period as is necessary to quantify the charges incurred which are to be deducted from the deposit. The security deposit will be used towards funding any loss or damage whatsoever to the van, equipment, fixtures and fittings as well as payment for the insurance excess.
Proof of Identification and of Address
Our insurance company requires us to verify your identification in two ways. We need to see and take a copy of your photocard driver licence for UK or EU licence holders. In addition, we require one item that confirms your address.
PROOF OF ADDRESS MUST BE ONE OF THE FOLLOWING:
- A credit card statement, dated within the last 3 months;
- Bank, Building Society, Credit Union statement, dated within the last 3 months
- Council Tax bill (valid for the current financial year)
- Current Tenancy Agreement, from a local council or a recognised letting agency
- HMRC document (PAYE Coding Notice/Tax Notification/Self-Assessment/Statement of Account/NI contributions bill) issued in the last three months or valid for the current tax year – we can’t acceptP45 or P60 forms
- Mortgage statement from a recognised lender, dated within the last 12 months
- Sky or cable TV bills, dated within the last 3 months
- Landline telephone bill, dated within the last 3 months – we can’t accept mobile phone bills
- Utility bill – gas, electricity or water, dated within the last 3 months
- A notification letter from Benefits Agency/Local Authority confirming your right to benefits (Department for Works and Pensions, Jobcentre Plus, Benefits Agency or Veterans Agency), dated within the last 12 months
This information is set and required by our insurance company as terms of cover. It is required for each named driver. Failure to accurately provide this at the point of collection will prevent you from driving the vehicle away, though the hire will still commence.
Please note that non-UK hirers will be asked to provide their driving licence and their passport.
Accidents/Theft or Vandalism
You must report any traffic accident involving the van to the police (and us) immediately and report loss, damage or theft involving the van to the police (and us) within 12 hours of the incident or discovery of the incident.
OUR 24 HOUR CONTACT IN THE EVENT OF AN
ACCIDENT OR EMERGENCY IS
In the event of an accident take the names and addresses of everyone involved, including witnesses, car registration numbers, together with all the details of the accident, time, place, how it came about, damage to vehicles etc. If you have a camera, take photos of the scene. Please do not move the vehicles before the police arrive, keeping them in situ is a safe thing to do.
Do not make any admission of liability to any other parties.
We cannot accept liability for any costs arising from accident, theft or vandalism e.g. replacement vehicle costs, travel, accommodation or phone calls. We will endeavour to assist you but the responsibility for self is yours.
In the event of theft, you must return the keys to us where possible.
You agree to co-operate with us and our insurers in any investigation or subsequent legal proceedings, providing evidence and attending court if necessary, arising out of any loss of or damage to the vehicle.
Breakdown & Maintenance
In the event of breakdown, recovery or repair services will be provided. All our vans have AA Roadside Assistance insurance cover. Please contact us on the emergency number above in the event of a breakdown. If you incur any minor repair bills we will give you a refund of up to £50. Just produce your valid vat receipt on the completion of your hire. Repairs costing in excess of £50 must first be authorized by ChillDayz Campers prior to the work being undertaken. A replacement van may be offered but this will be subject to availability. We cannot accept liability for any costs arising from accident, breakdown or any other cause. ChillDayz Campers liability extends to either replacing your van with a similar one or refunding your hire charge for any days you lose the total use of the vehicle. You will need to return to the handover location, at your own cost, but preferably with the breakdown service returning your original camper van, to collect a replacement vehicle, if one is available. If you have broken down you must remain at a safe distance from the vehicle until the AA Recovery Vehicle arrives. You must not abandon the vehicle at the roadside if you wish to continue your journey with another form of transport. You must hand over the keys to the AA Recovery Vehicle Driver.
Collection and Return
The campervan must be returned to us in the same condition in which it left our care, inside and out – with same amount of fuel as upon pick up.
We will arrange a one-hour collection time and location with you in advance. Normally this will be at Totnes Rail Station between 12:00 and 14:00 – outside of these hours and at a different location with our agreement. Late arrival to collection will incur a waiting charge of £50 for more than one hour. The vehicle will be full of fuel.
We will run through the van with you prior to leaving, including all systems, inventory/contents, handling and safety. Once satisfied we will run through these terms and conditions, the rental agreement, and your identification. Note, the deposit bank transfer must be in our account by this point otherwise you will not be able to drive the vehicle away. This can all take up to an hour.
We will arrange a one-hour return time and location with you in advance. Normally this will be at Totnes Rail Station between 10:00AM – and 12:00PM – outside of this time and at a different location with our agreement. Late arrival to the return handover will incur a waiting charge of £50 for up to one hour. More than one hour and we will charge an additional day’s hire. You must give yourself at least thirty minutes for us to inspect the van for damage/loss and for you to unpack your belongings from the van.
The fuel tank will be full on collection and must be returned to us full. An administration charge of £25, plus the cost of the missing fuel will be deducted from your security deposit if the van is returned with missing fuel. The vans take Diesel fuel.
We want you to have your campervan holiday, however sometimes we must allow for unforeseen circumstances. We reserve the right to provide you with a suitable alternative campervan, without notice if the vehicle you booked has been taken off the road or is unavailable due to circumstances out of our control. Should a substitute not be available, our liability is limited to a full refund of monies received by ChillDayz Campers. We will not have any other liability to you. All rights are reserved to refuse any hire under any circumstance. No refunds are payable on accommodation, or vehicles not being available where a hirer changes, cancels or seeks to vary agreement after departure. The company takes no responsibility for any detention, delay, loss, damage or injury that a hirer might experience no matter how it is caused or by whom. You acknowledge that you will be responsible for any loss or damage to the vehicle, its documents, parts or accessories arising during the rental. If you cause damage to the vehicle’s engine through driving too fast, over too long a period of time, and ignoring the warning lights, you will be liable for any repairs required or even the cost of a replacement engine.
Treatment and conduct
The hirer agrees that during the rental period, he/she will not and will not allow the vehicle to be:
- Driven otherwise than in a cautious, prudent and normal manner;
- Used in a manner which could cause damage;
- Driven in a prohibited area;
- Driven by a person under the influence of alcohol or drugs or with a blood alcohol level in excess of that permitted by law;
- Left with any door or the boot unlocked while it is unoccupied;
- Left with the ignition key in the vehicle while it is unoccupied;
- Driven by persons:
- Under the age of 23 years; or
- Who is not authorised by law to drive the Vehicle.
- Under the age of 23 years; or
- Damaged by:
- Submersion in water;
- Contact with Salt Water;
- Proximity to heat, fire or dangerous chemicals.
- Submersion in water;
- Used for any illegal purpose for any race, rally or contest;
- Used to tow any vehicle or trailer;
- Used to carry passengers or property for hire or reward;
- Used to carry more persons than is permitted by any relevant authority or detailed in the Vehicle manual or on the Vehicle or specified in this agreement;
- Used to carry volatile liquids, gases, explosives or other corrosive or inflammable material;
- Otherwise used in breach of my obligations under this Agreement.
The hirer agrees that during the rental period, he/she will:
- be responsible for the cost of making good any damage caused to the vehicle by improper use;
- understand that any damage to the interior of the vehicle or equipment will be charged to the hirer in all cases;
- Understand that ChillDayz Campers are not liable to you or any authorised driver or passenger for loss of or damage to property left in the vehicle either during or after the hire period unless such loss or damage results from our negligence or breach of this Rental Agreement. Such property is entirely at your own risk.
Use on an aerodrome, airport, airfield or military base provided for aircraft to take off and land or move on the surface; or aircraft parking aprons including service roads refuelling and ground equipment parking areas is excluded. Use for, racing, pace making, competitions, rallies, track days, trials or speed tests whether on the road, track, off road, land prepared for such use or the Nurburgring Nordschleife and whether the event is organised or informally arranged is excluded. The Insured vehicle shall not be used for the carriage of goods of an explosive, dangerous or hazardous nature or for the carriage of goods or passengers for hire and reward or any other form of profit or remuneration.
Damage and Loss
The vehicle is hired to you in a sound condition. The expectation and agreement is that the vehicle will be returned in the same condition, inside and out. You will be liable to us for all losses and costs incurred by us in the event of loss, damage to or theft of the vehicle, its parts or accessories, while on rental if this damage, loss or theft involves deception of the hirer or another party, or as a result of the keys remaining in the vehicle whilst it is unoccupied, or was caused intentionally by you or your party.
Your liability may include the cost of repairs, loss in value of the vehicle, loss of rental income, towing and storage charges and an administration charge, which recovers our costs for handling any claim arising from damage caused to the vehicle unless responsibility for the damage lies with us or has been determined by a third party or their insurers to lie with the third party. You will not be liable to us for any charge or excess if the loss or damage is directly due to our negligence or breach of this rental agreement.
Seat Belts, Booster and Baby Seats
You must carry only as many passengers as there are seat belts in the van. You are legally responsible for obtaining and using a child or baby seat. The fitting of any such equipment is the sole responsibility of you and we can accept no liability whatsoever.
Sorry – we DO NOT allow dogs / pets to accompany you in the campervan.
It is illegal to smoke inside our vans or tents. You will be liable for any damage caused to the van, their awning or their contents through smoking.
In the event that keys are lost or damaged you will be liable for the costs of obtaining a replacement.
Extent of Hire
There is no mileage limit and no geographical limit for the hire. However, the vehicle is not allowed to travel outside of the UK without prior agreement.
Gas & Batteries
Gas and batteries are provided as part of the vehicle hire. If you need to purchase gas during your hire period, the cost will be refunded to you on your return on production of a receipt from the place of purchase.
In the event of a cancellation the following charges apply:
- More than 8 weeks prior to departure 15% retained.
- Less than 8 weeks and more than 4 weeks prior to departure 50% retained.
- Less than 4 weeks and more than 2 weeks prior to departure 75% retained.
- Less than 2 weeks prior to departure 100% retained.
We advise all hirers to take out their own holiday insurance to cover any eventualities.
Personal Travel Insurance
It is the hirer’s responsibility to provide their own insurance to cover personal items and belongings whilst on holiday as well as covering themselves against personal accident or injury when the campervan is not being driven. Personal Travel Insurance is also advised to protect your holiday costs in the event of force majeure and subsequent cancellation. The insurance that we provide does not cover your personal belongings, or any accident or injury whilst not driving the camper, or any cancellation by you due to force majeure.
When you make your booking, we will collect personal information such as your name, email address, home address, and telephone number. This allows us to book the vehicle and insurance for you. We may use the information that we collect to occasionally notify you about news and information. If at any stage you decide that you would rather not receive such information, please contact us by telephone, email or post. We reveal your identity information to our insurance company only.
Our insurance company is required to maintain the hire agreement and supporting information in a secure database for three years. This is common industry practice.
Termination of the Agreement
You acknowledge that ChillDayz Campers may terminate this Agreement and repossess the Vehicle at any time, without notification to you, and that you will pay the reasonable costs of repossessing the Vehicle, including towing charges if:
- You are in breach of any of these Terms and Conditions;
- You have obtained the Vehicle through fraud or misrepresentation;
- The Vehicle appears to be abandoned;
- The Vehicle is not returned at the agreed return date and time, or ChillDayz Campers reasonably believes that the Vehicle will not be returned at the agreed return date and time.
- ChillDayz Campers considers on reasonable grounds, that the safety of passengers or the condition of the Vehicle is endangered. You understand that in the event of such termination or repossession, you have no right to a refund of any part of the rental charges or the Security Deposit.
We ask that you exercise caution at all times in the use of the campervan and its equipment, following instructions (given verbally or in written form on collection) where appropriate.
